Overview

This website and online store are operated by True Emanation LLC. Throughout these Terms of Service, the terms “True Emanation,” “we,” “us,” and “our” refer to True Emanation LLC.

These Terms of Service govern your access to and use of trueemanation.com and any related content, features, products, tools, and services we provide collectively, the “Services.”

By accessing the Services, creating an account, or purchasing a product, you agree to these Terms of Service and the policies incorporated into them, including our Privacy Policy and Return and Refund Policy. If you do not agree, you should not use the Services.

Nothing in these Terms limits any consumer right that cannot legally be limited or waived.

Section 1 — Eligibility and Accounts

You must be at least the age of majority in your jurisdiction to make a purchase. If you allow a minor to browse or use the Services, you are responsible for supervising their use.

You agree to provide accurate, current, and complete information when creating an account, placing an order, or contacting us.

You are responsible for safeguarding your account credentials and for activity occurring through your account. Contact us promptly if you believe your account has been accessed without authorization.

You may not transfer, sell, assign, or license your account to another person.

Section 2 — Products and Product Information

True Emanation products are handcrafted and may incorporate natural crystals, gemstones, pearls, metals, and other materials.

Because natural and handmade materials vary, individual products may differ slightly in color, clarity, inclusions, pattern, texture, shape, bead size, finish, or arrangement. These natural and handcrafted variations make each piece unique and are not ordinarily considered defects.

We make reasonable efforts to display products accurately. However, colors and proportions may appear differently depending on your screen, device, lighting, and display settings. Measurements and dimensions are approximate unless expressly stated otherwise.

Product descriptions, availability, materials, pricing, and designs may be updated without notice. We may discontinue products or limit quantities by customer, order, geographic location, or jurisdiction.

Section 3 — Crystal Meanings and Wellness Disclaimer

Descriptions of crystal meanings, intentions, energies, symbolism, spiritual traditions, and metaphysical properties are provided for informational, cultural, spiritual, and entertainment purposes.

These descriptions reflect traditional beliefs and personal interpretations. They are not medical or scientific claims, and individual experiences may vary.

True Emanation products and content are not intended to diagnose, treat, cure, prevent, or mitigate any disease or medical condition. They are not a substitute for medical care, mental-health care, medication, diagnosis, or advice from a qualified healthcare professional.

Do not delay or discontinue professional care because of information found through our Services. We do not guarantee any particular emotional, spiritual, physical, financial, or health-related result from using or wearing our products.

Section 4 — Jewelry Safety and Care

Jewelry may contain small parts and can present a choking hazard. True Emanation jewelry is not a toy and should be kept away from children under three years old.

Jewelry intended for children should be worn only under direct adult supervision. Jewelry should generally be removed before sleeping, bathing, swimming, strenuous physical activity, or any activity in which it could catch, stretch, or break.

Inspect jewelry regularly. Stop wearing an item if its cord, clasp, chain, setting, or other component becomes damaged or weakened.

Some people may be sensitive or allergic to certain metals, minerals, finishes, or other materials. Discontinue use if irritation or discomfort occurs and seek appropriate medical advice when necessary.

You are responsible for selecting an appropriate size and following any product-specific care and safety instructions.

Section 5 — Orders and Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean that we have accepted it.

We may accept, decline, limit, or cancel an order for legitimate reasons, including inventory errors, suspected fraud, pricing mistakes, payment issues, shipping restrictions, or violations of these Terms.

If we cancel an order after payment has been processed, we will issue the appropriate refund to the original payment method.

Please review your order carefully before submitting it. Contact us as soon as possible if you need to request a cancellation. We may not be able to cancel or change an order after production, processing, or fulfillment has begun. This does not limit any cancellation or withdrawal right provided by applicable law.

Unless we approve a separate wholesale or commercial arrangement, products purchased through the Services are intended for personal or household use and not unauthorized resale or export.

Section 6 — Prices, Payment, Taxes, and Promotions

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed and confirmed at checkout when the order is placed.

Depending on your location and store settings, prices may be displayed in different currencies. Your bank or payment provider may charge conversion or international transaction fees that we do not control.

You agree to provide accurate billing and payment information and confirm that you are authorized to use the payment method provided.

Applicable taxes, shipping charges, duties, customs charges, and other amounts will be displayed or described at checkout when reasonably possible. Additional import charges may be assessed by the destination country.

Promotions may have separate eligibility requirements, expiration dates, exclusions, or other conditions. If promotional terms conflict with these Terms, the specific promotional terms control for that promotion.

If we discover a material pricing or product-information error after an order is submitted, we may contact you for confirmation or cancel the affected item and issue a refund.

Section 7 — Shipping and Delivery

Shipping and delivery dates are estimates unless expressly guaranteed. We will make reasonable efforts to ship orders within the time stated when you purchase.

If a material delay occurs, we will provide notice and any cancellation or refund options required by applicable law.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after fulfillment begins.

Unless applicable law provides otherwise, risk of loss transfers to you when the order is delivered to you or a person you designate at the shipping address provided. If you independently select a carrier that we did not offer, risk may transfer when the order is provided to that carrier.

We are not responsible for delays caused solely by carriers, customs processing, severe weather, natural disasters, labor disruptions, government actions, or other events outside our reasonable control. This does not limit our legal responsibilities regarding delivery, cancellation, damaged products, or refunds.

Section 8 — International Orders

We ship to eligible international destinations. Availability may depend on the product, destination, carrier, customs restrictions, or applicable law.

Unless checkout states that duties and taxes are prepaid, international customers are responsible for customs duties, import taxes, brokerage charges, and other destination-country fees.

Customs processing can delay delivery. We cannot control or guarantee customs-clearance times.

Refusing an international shipment or failing to pay required import charges does not automatically cancel the order. Any resulting return or refund will be handled according to our Return and Refund Policy and applicable law.

Section 9 — Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Return and Refund Policy:

Our voluntary policy allows eligible returns for any reason within 60 days after delivery. Conditions, return instructions, shipping responsibilities, and refund timing are explained in that policy.

The Return and Refund Policy does not limit any mandatory cancellation, withdrawal, refund, warranty, or consumer-protection rights that apply in your country or region.

Section 10 — Warranties

Certain products may be covered by an expressly stated product warranty or our Lifetime Restringing Warranty. Eligibility, exclusions, claim procedures, and available remedies are governed by the warranty terms published here:

A voluntary True Emanation warranty is provided in addition to, and does not replace or limit, any statutory warranty, consumer guarantee, or other right that cannot legally be excluded.

No employee, representative, or third party may create or modify a warranty unless the change is confirmed by True Emanation LLC in writing.

Section 11 — Intellectual Property

The Services and their content—including trademarks, business names, logos, product names, jewelry designs, crystal and intention icons, photographs, videos, text, graphics, illustrations, layouts, and other materials—are owned by or licensed to True Emanation LLC and are protected by applicable intellectual-property laws.

We grant you a limited, revocable, non-exclusive, and non-transferable right to access and use the Services for personal, noncommercial purposes.

Without our written permission, you may not reproduce, modify, distribute, sell, license, publicly display, republish, scrape, download, store, or commercially exploit our content except where applicable law expressly permits the activity.

True Emanation names, logos, designs, product names, and slogans may not be used in a manner that suggests sponsorship, endorsement, affiliation, or authorization without written permission.

All rights not expressly granted are reserved.

Section 12 — Optional Tools and Third-Party Services

The Services may provide access to tools, payment services, applications, or features operated by third parties.

We do not necessarily control or monitor those services. Your use of a third-party service may be governed by that provider’s terms, privacy policy, and other requirements.

To the extent permitted by law, third-party tools are made available without additional warranties from True Emanation. You are responsible for reviewing the applicable third-party terms before using them.

Section 13 — Third-Party Links

The Services may contain links to websites, content, or services operated by third parties.

We are not responsible for the content, accuracy, availability, security, or practices of third-party websites. Accessing a third-party website is at your discretion and may be subject to separate terms and privacy policies.

Questions or disputes regarding third-party products or services should generally be directed to the applicable provider.

Section 14 — Relationship With Shopify

True Emanation is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

Sales made through our store are transactions directly between you and True Emanation LLC. Shopify is not the seller of True Emanation products and is not responsible for fulfilling our orders, evaluating our products, or administering our voluntary warranties.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising specifically from products purchased directly from True Emanation. Nothing in this section limits any right or remedy that cannot legally be limited.

Section 15 — Privacy and Electronic Communications

Our collection and use of personal information are governed by our Privacy Policy:

Because Shopify hosts the Services, Shopify may also process information about your use of the store. Shopify’s Consumer Privacy Policy is available here:

Information may be processed by Shopify and other service providers in countries outside your place of residence, as described in the applicable privacy policies.

By placing an order or contacting us, you agree that we may send transactional communications concerning your account, purchase, payment, shipping, return, warranty claim, or customer-service request.

Marketing emails or messages will be sent according to your choices and applicable consent requirements. You may unsubscribe from marketing communications using the instructions included with them. Unsubscribing from marketing does not prevent necessary transactional communications.

Section 16 — Reviews, Feedback, and Submitted Content

If you submit a review, photograph, video, comment, suggestion, testimonial, or other content directly to True Emanation or through the Services, you grant True Emanation LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, edit, adapt, publish, display, distribute, and promote that content in connection with our business.

You retain any ownership rights you otherwise hold in your submitted content.

You confirm that:

You created or have permission to submit the content.
The content is truthful and reflects your honest experience.
The content does not violate another person’s copyright, trademark, privacy, publicity, or other rights.
The content does not contain unlawful, abusive, deceptive, defamatory, obscene, or malicious material.
You have disclosed any payment, free product, discount, commission, family relationship, employment relationship, or other material connection to True Emanation when disclosure is required.

We may moderate, decline, edit for formatting, or remove submitted content. We will not materially alter the meaning of a review or create a misleading endorsement.

We are not required to keep feedback confidential, provide payment, publish it, or respond unless we separately agree in writing.

Section 17 — User-Generated Content and Social Media

Tagging or mentioning True Emanation, or using a True Emanation hashtag, may bring your content to our attention but does not automatically grant us permission to use it.

If we contact you and you reply with #YesTrueEmanation, or otherwise provide clear written permission, you grant True Emanation LLC and its service providers a non-exclusive, worldwide, royalty-free license to use, reproduce, crop, edit, adapt, publish, display, distribute, repost, and create promotional materials from the approved photograph, video, caption, or other content.

This permission includes use on our website, organic and paid social-media accounts, email marketing, digital advertising, printed materials, event displays, and other True Emanation promotional materials.

You also permit us to use any name, social-media username, image, likeness, voice, and statement appearing in the approved content.

You confirm that you created or own the content, have permission from the photographer and everyone identifiable in it, and that our permitted use will not violate another person’s rights.

If a minor appears in the content, you confirm that you are the minor’s parent or legal guardian or have permission from their parent or legal guardian.

No payment or other compensation will be owed unless we agree to it separately in writing. We may credit your social-media account when practical, but credit is not guaranteed.

If you received payment, free or discounted products, commission, or another benefit connected to the content, you agree to make any disclosure required by applicable advertising law. True Emanation may also add an appropriate disclosure when reposting or using the content.

You may revoke permission for future use by contacting info@trueemanation.com. Revocation will not affect content already published, printed, scheduled, or incorporated into existing materials before we receive your request, except where removal is required by applicable law.

Section 18 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, pricing, promotions, availability, shipping charges, or delivery estimates.

We may correct information and update the Services at any time. If an error materially affects an order you already placed, we will take reasonable steps to notify you and provide any options required by applicable law.

Section 19 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

Violate any law, regulation, or another person’s legal rights.
Infringe intellectual-property, privacy, publicity, or data-protection rights.
Submit false, deceptive, defamatory, abusive, threatening, or unlawful content.
Impersonate another person or misrepresent your identity or affiliation.
Transmit malware, harmful code, spam, phishing messages, or unauthorized advertising.
Collect personal information about others without authorization.
Interfere with the security, availability, or operation of the Services.
Bypass access controls, purchase limits, fraud controls, robot exclusions, or security measures.
Make fraudulent purchases or unauthorized payment attempts.
Reproduce, resell, or commercially exploit the Services or their content without permission.

We may suspend or terminate access if we reasonably believe these Terms have been violated.

Section 20 — Automated Access and Agents

Search engines, accessibility tools, authorized shopping assistants, and other automated services may access publicly available portions of the Services when they comply with applicable law, our published technical instructions, and reasonable rate limits.

Automated systems and agents may not:

Circumvent security measures, CAPTCHAs, access restrictions, or purchasing controls.
Conceal or misrepresent their automated nature when identification is reasonably required.
Collect personal information or nonpublic data without authorization.
Place an order without the informed authorization of the person responsible for the purchase.
Disrupt, overload, scrape, copy, or exploit the Services in an abusive manner.
Ignore a request to stop or restrict automated access.

We may use technical measures to limit automated access that threatens security, privacy, availability, or the rights of True Emanation or others.

Section 21 — Suspension and Termination

We may suspend or terminate your access to the Services if you materially violate these Terms, misuse the Services, engage in fraud, threaten security, or create legal risk.

Termination does not eliminate payment obligations or liabilities that arose before termination.

Sections that by their nature should continue—including intellectual property, content licenses, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions—will survive termination.

Section 22 — Disclaimer of Warranties

Information provided through the Services is offered for general informational purposes. We do not guarantee that all content will always be complete, current, uninterrupted, secure, or error-free.

Except for warranties expressly provided by True Emanation and rights that cannot legally be excluded, the Services are provided on an “as available” basis.

To the fullest extent permitted by law, we disclaim implied warranties relating solely to the operation of the website, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

This section does not exclude any express product description, voluntary warranty, statutory warranty, consumer guarantee, or other obligation that cannot legally be excluded.

Section 23 — Limitation of Liability

To the fullest extent permitted by applicable law, True Emanation LLC and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the Services.

This limitation may include lost profits, lost revenue, loss of data, loss of opportunity, or replacement costs when those damages were not reasonably foreseeable or are legally excludable.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability that may arise from:

Fraud or fraudulent misrepresentation
Gross negligence or willful misconduct
Death or personal injury caused by negligence where such liability cannot be limited
Breach of mandatory consumer rights
Defective products where applicable product-liability law prohibits exclusion

Different jurisdictions provide different limitations and remedies. These limitations apply only to the extent permitted in your location.

Section 24 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless True Emanation LLC and its owners, employees, contractors, and service providers from third-party claims, damages, and reasonable expenses arising directly from:

Your unlawful or fraudulent use of the Services
Content you submit without the necessary rights or permissions
Your material violation of these Terms
Your infringement of another person’s legal rights

This section does not require a consumer to indemnify us for our own negligence, misconduct, breach of contract, or violation of law.

Section 25 — Governing Law and International Consumer Rights

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict-of-law principles.

Subject to any mandatory right you have to bring a claim elsewhere, disputes may be brought in the state or federal courts with jurisdiction over Johnson County, Kansas.

If you are a consumer outside Kansas, this governing-law provision does not deprive you of mandatory protections provided by the laws of your country, state, province, territory, or region.

Customers in the European Union, European Economic Area, United Kingdom, Australia, Canada, and other jurisdictions may have statutory cancellation, withdrawal, refund, repair, replacement, delivery, warranty, privacy, or consumer-guarantee rights that cannot be excluded. Those rights remain in effect.

If any provision of these Terms conflicts with a mandatory consumer-protection law applicable to you, the mandatory law controls to the extent of the conflict.

Section 26 — Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent legally permitted or severed when necessary.

The remaining provisions will remain valid and enforceable.

Section 27 — Waiver, Entire Agreement, and Assignment

Our failure to enforce a provision does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the entire agreement governing your use of the Services and replace earlier versions relating to the same subject.

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer these Terms in connection with a merger, restructuring, financing, sale of assets, or transfer of the True Emanation business, subject to applicable law.

Section 28 — Changes to These Terms

We may update these Terms to reflect changes to the Services, our business practices, technology, or applicable law.

The current version will be posted on this page with an updated effective date. When required by law, we will provide additional notice of material changes.

Changes apply prospectively from their effective date unless applicable law permits otherwise. Continued use of the Services after a change takes effect constitutes acceptance where permitted by law.
